‘Dismiss DF Leave For Judicial Review’

ATTORNEY General Likando Kalaluka has asked the High Court to dismiss the leave granted to the Democratic Front (DF) to commence judicial review of the decision by Minister of Home Affairs Davies Mwila to de-register the party.
This is according to an affidavit in support of summons for an order discharging leave to apply for judicial review filed in the High Court by assistant senior state advocate Mubanga Kalimamukwento.
DF secretary-general Morgan N’gona is seeking the court’s permission to review Mr Mwila’s decision to revoke the certificate of registration of the party.
The State contends that Mr N’gona is not registered as the secretary-general of the DF according to the register at the Registrar of Societies, but that Adwick Nyendwa is the registered secretary-general.
Mr Kalaluka submitted that another person also emerged purporting to be the secretary-general of the DF, who wrote to the Chief Registrar at the Registrar of Societies purporting to be the secretary-general of the party.
“On 20th January, 2016, one Namakau Kaingu also wrote to the office of the Chief Registrar at the Registrar of Societies purporting to be the secretary-general of the Democratic Front,” part of the affidavit reads.
The State further contended that the documents filed by Mr N’gona enlisting office bearers do not have an official stamp or letterhead.
Mr Kalaluka asked the court to discharge the leave granted to Mr N’gona to commence judicial review proceedings.
In an earlier ruling, High Court judge Judy Mulongoti granted Mr N’gona of the DF permission to apply for judicial review of Mr Mwila’s decision to revoke and cancel the certificate of registration of the DF.
Mrs Justice Mulongoti also ordered that the judicial review should also operate as a stay.
